PercyTech Terms of Service

1. Acceptance of Terms

By accessing or using PercyTech ("Service"), you agree to these Terms of Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Services

PercyTech provides business software for operator communication, including SMS/MMS workflows, account and inbox administration, AI-assisted agent surfaces, customer websites, lead capture, and related implementation services.

3. Customer Responsibilities

• Provide accurate account, billing, business, and configuration information.
• Maintain the security of user accounts, credentials, API keys, and integrations.
• Review AI-assisted outputs before relying on them in business workflows.
• Supply content, brand assets, business rules, and implementation requirements.
• Ensure all users in the organization follow these Terms and applicable law.

4. Prohibited Use

• Unlawful activity, spam, phishing, fraud, or deceptive messaging.
• Security abuse, unauthorized access, scraping, or service disruption.
• Intellectual property infringement or privacy violations.
• Misuse of AI systems, including unlawful profiling or deceptive impersonation.

5. Third-Party Providers

The Service may depend on third-party platforms for messaging delivery, hosting, authentication, AI processing, analytics, payments, email, and infrastructure. Those services are governed by their own terms, pricing, privacy practices, availability, and technical limits.

6. Billing

Subscription, usage, implementation, or support fees are billed according to the applicable order form, checkout flow, invoice, or written agreement. Unless a written agreement says otherwise, fees are non-refundable except where required by law.

7. Ownership

Customer-provided content remains with the customer. PercyTech retains rights to the Core platform, pre-existing tools, reusable code, templates, know-how, and general methods developed outside a customer-specific deliverable unless a written agreement says otherwise.

8. Availability and Changes

We may modify, suspend, or discontinue features, perform maintenance, update pricing, or restrict access for legal, security, operational, or abuse-prevention reasons. We do not guarantee uninterrupted or error-free service.

9. No Guaranteed Outcome

PercyTech is designed to support practical operator workflows, but no platform, message campaign, AI workflow, website, or implementation recommendation can guarantee a specific revenue, traffic, funding, or operational result.
